The monthly meeting of the Ray Township Board
of Trustees was called to order at 7:30 p.m. by Supervisor Bohm.
The Pledge of Allegiance was recited.

Bohm spoke with Mr. John Hage in relation to
contacting the county in reference to becoming a CDBG Fund participant.
4. APPROVAL OF MINUTES
a. May 5, 2010
Bohm suggested a correction to the Public
Comments Section – Revision to the second paragraph in relation to the Kevin
Morton complaint to indicate that it would be the Department of Natural Resources
and Environment’s responsibility since the problem is out of the road
right-of-way.

b. May 13, 2010 – Special Board Meeting
The Special Board
Meeting was called for the purpose of approving the language for the August ballot
for the renewal of the Fire Department millages.

5. APPROVAL OF BILLS:
Stier explained that Item #33 is for two
invoices from Romeo Computer totaling $2,287.47 for server repair and upgrades.
Stier further explained that the Fairfield Inn
for $357 plus miles and meals for $132 were for the Treasurer’s Education Week
that Stier attended in April.
He also noted that the Michigan Township
Association Annual dues in the amount of $3,462.97 is on the bills list.
Member Grader asked if the Michigan Township
Association Annual dues increase yearly. Bohm stated that the dues are based
on the Census figures for the township.

6. OFFICER'S REPORTS
a. Supervisor
Bohm reported the following:
1. Letter has received from the Huron Clinton
Metroparks in response to the Township’s request that they participate in the
payment for having crushed limestone
applied to Wolcott
Road
from the entrance to the Farm Learning Center to 32 Mile
Road. They have agreed to pay ˝ of the
Township’s portion of the invoice for the project, or approximately $5,500.
2. Stier and Bohm attended USDA workshop last
week, anyone requiring financing options on homes in the area can contact
the office for the information obtained
at that workshop.
3. The bid
packages for the Energy Grant have been completed and ready for any contractors
wishing to purchase one. A
walk-thru of
the project was completed on May 27th. The finalized bids are due
back at the Township on June 9 by 3:00
P.M.
4. Quotes are
being requested from other waste haulers in reference to the recycle area. Bohm
is currently looking at a
couple of
alternatives to the current system. One would be to only open the center at
certain times; or to have a packer
truck
available on-site. It is currently costing the Township approximately $1,000
per month to have the recycle station
open and
running as it is.
5. Thank you to Dora
Osborne and Ann Bartold for planting the flowers around the township.

c. Treasurer
Stier reported the following:
1. Bohm and Stier attended
a meeting at the Fire Hall with Fanning/Howey the architectural firm that is
handling the New
Haven School project, regarding the lagoon system. The
system will be equipped with a bubbler, which will keep the lagoon aerated. It
is estimated that the first discharge into the Clinton River, which is
regulated by the Department of Natural Resources and Energy, will be after one
year. Following the first discharge, it is estimated that a discharge will take
place twice a year.
The Lagoon System consists of two 30 foot
diameter lagoons that are 18 feet deep. Both lagoons will be fenced and
landscaped. There is also a septic system on site which is independent of the
lagoon. There will be a dry hydrant at the school property. There is also a
wet hydrant outside of the school property. A grand-opening of the site will
be held on August 31.
Chief DiMaria stated that an early warning system siren
may be put on the lagoon site, with the power coming from the
pump house. It will also be equipped with a battery
back-up. The radius of the siren is 2 ˝ miles.
d. Trustees
Grader reported on the following:
1. In relation to the early warning system,
is it possible to have the siren located at 27 and Romeo Plank louder, as there
a times that you cannot hear it inside the house? Chief DiMaria stated that it
is not intended to be heard in the house, it is an outside early warning siren.
He further stated that as the township gets more coverage, they will seem
louder because there will be more of them in the area.
2. What is the status of the Department of Natural
Resources and Environment for the demolition of the Cascades? Bohm asked to
defer this item to Public Comments, as Terry Goike of the Historical Society
was in the audience and had requested time to speak on the issue.
Zoccola reported the following:
1. The first application of dust control has
been applied and some residents have not been satisfied that the coverage was
sufficient. Bohm stated that this product works better with rain and since it
has rained the application seems better and will be even better with another ˝
inch of rain. Zoccola stated that this product is inferior to the chloride
applications that used to be done, however the cost of the chloride has gotten
so prohibitive that the Township cannot supply it anymore.
Bohm addressed Grader regarding information he
had received that stated that the IT Director at Macomb County has resigned. Grader stated that it is her
understanding that the current deputy is taking over temporarily.
Grader inquired whether there were any funds
available through the USDA for Broadband. Bohm stated that there is financing
available for rural area needs.
7. DEPARTMENT REQUEST / REPORTS

b. Fire Department
Request
Fire Department requested the purchase of new
pagers and a recorder (to give the Fire Department the ability to record what
is going on on-scene) using the COPS grant. It was further stated that these
items will help with the ISO rating of the Fire Department. Total funds requested for these
items is $5,600; with the remainder of the funds being used for replacement
batteries.

MOTION TO APPROVE THE FIRE DEPARTMENT REQUEST
FOR THE PURCHASE OF A DIGITAL LOGGING RECORDER WITH INSTALLATION AT THE COST OF $4,500 AND 2 MINITOR V PAGERS
WITH 4 YEAR EXPRESS SERVICE IN THE AMOUNT OF $1,050; UTILIZING ANY REMAINING FUNDS
FROM THE 2008 COPS GRANT FOR THE PURCHASE OF BATTERIES. MOTION CARRIED.
Chief DiMaria introduced firefighters: Kyle
Heckman, and Brian Schoenjann to the Board, both firefighters received their
badges in March 2010. He also introduced Kevin Dittenber who will get his badge
in March 2011.
8. UNFINISHED BUSINESS
a. Hartway Dobson Lot
Bohm sent a final offer to the person who was interested in
purchasing the lot on Linda
Lane on May 6 and has
not heard back from them at this time. Bohm stated that he is waiting 30 days
to hear back from the purchaser before requesting that additional action be
taken.

Complaint
Bohm has spoken to the person who the complaint is against and a
meeting has been set up for June 3 at 9:30 with
the homeowner, Bohm and Zoccola.

9. NEW BUSINESS
a. Annual MTA Dues
Discussed under Bills List.
b. Message Board for the Park
Ray Township Eagle Scout who has asked to
erect a message board on the property (in the park). Kirk has called him
and left a message
and has not heard back from him. Plans were requested and item will be
revisited when they are
received.
c. Sign Ordinance
Bohm stated that a copy of the Planner’s
recommendation for the sign ordinance was given to each of the Board
members. Board members discussed the following
items in the ordinance:
1) Definition of “immediate”
corner
2) Size of the sign
allowed
3) Color of the lights in
the sign
4) Micro-managing
businesses in the township
5) Restrictiveness of the
ordinance as it is written
6) Changes that could be
made when the entire sign ordinance is reviewed by the Planning Commission.
7) Legality of restricting signs to the
corners only
8) Sending comments to the
Planning Commission members.
Kevin Brown of 18955 29 Mile Road stated that he feels
that the Board is attempting to micro-manage businesses and does not feel that
it would stand up in a court of law. He further stated that he sometimes
wonders if the Township is promoting business in the Township or not.
Dave Ebert of 19500 30 Mile Road stated that the color
was discussed at the Planning Commission and the entire sign ordinance will be
re-addressed within the next year.
Kevin Brown of 18955 29 Mile Road asked if the school
comes to the board are you turning them down? If the Fire Department comes are
you turning them down?
Stier stated that the school is state
controlled and they will put one up if they want to. They are not bound by the
Board, they come only as a courtesy.
Grader would like the item tabled for a month.

d. Tax Reversion – Parcel #05-32-300-017
The County Treasurer’s office has advised the Township that there
is a parcel of 18 acres of land on Romeo Plank
North of 26 Mile Road that has come available
through the tax sale process. The property is available first to the
state and then to the Township; it is
$5,770.78 in tax arrearage.

e. Master Plan Resolution
Resolution Number 2010-04

RESOLVED THAT:
WHEREAS, the Township Planning Act (P.A. 33 of 2009
as amended) provides the Ray Township Planning Commission with the authority to
prepare and adopt a community-wide Master Plan and,
WHEREAS, the Township Planning Commission has
developed a plan which contains an, Introduction Section, Demographic Section,
Environmental Section, Existing land Use Section, Planning Policy Section,
Liabilities Assets Needs and Desires Analysis Section, Agricultural Areas Plan,
Residential Plan, Nonresidential Plan, Community Facilities Plan, Thoroughfare
Plan, Implementation Section, a Master Land Use Plan map and associated
appendices, and
WHEREAS, the Plan is intended to serve as a guide
for the future development of the Township, and
WHEREAS, the Plan was distributed for review to
regional, county and local planning agencies and municipalities as required by
Statute, and
WHEREAS, a Public hearing was held at the regular
meeting of April 13, 2010 on the Master Plan, and
WHEREAS, the Ray Township Planning Commission, on
the date, May 11, 2010, adopted the Plan by resolution.
NOW, THERFORE,
BE IT RESOLVED, that the
Ray Township Board of Trustees also adopts the Master Plan as its policy guide
for future land decisions.

e. Renewal of Richmond Lenox EMS Contract
Contract received it is the same as last year’s
agreement. Period of contract July 1, 2010 – June 30, 2011.
DiMaria stated that there is no cost from the
township, however residents who use the service are billed through their
insurance company.

MOTION TO APPROVE THE RENEWAL OF THE RICHMOND LENOX EMS CONTRACT FOR THE
PERIOD OF ONE YEAR (July 1, 2010 through June 30, 2011). Motion Carried.
f. Request from Simon Morrow
Bohm stated that he received a letter from Washington Township in reference to two Ray Township addresses. Mr. Simon
Morrow owns the property at 15215 26 Mile Road and 15325 26 Mile Road (26 Mile Road and Hayes). The
wells at these addresses have been deemed unfit for human consumption. Washington Township has agreed to provide
water to the site, through an agreement with the homeowner. Washington Township needs a letter from
the township stating that the Township does not have an issue with the
arrangement between the homeowner and Washington Township. This request is for preliminary approval and
Ray will see the final before it is signed and completed. Bohm stated that his
understanding is that the pipe is 1”.

MOTION TO GIVE PRELIMINARY APPROVAL TO WASHINGTON TOWNSHIP TO PROVIDE WATER TO
THE PROPERTIES AT 15215 26 MILE ROAD AND 15325 26 MILE ROAD THROUGH A PRIVATE
AGREEMENT WITH MR. SIMON MORROW AS REQUESTED. A FORMAL AGREEMENT TO BE
PRESENTED TO THE RAY TOWNSHIP BOARD PRIOR TO IT’S COMMENCEMENT. MOTION CARRIED.
10. PUBLIC COMMENTS –
Terry Goike at 21122 32 Mile Road in reference to the
Cascades Dam, would like to know what the Township Board’s stance is on the
plans for the dam.
Bohm stated that the governing parties are the
Department of Natural Resources and Environment and the property owner to the
south.
The Board of Trustees discussed the project.
It was also noted that another meeting is to be set up after the 14th
of June to further discuss the project. Jim Frances of the DNRE fisheries is
going to set up the meeting. The public hearing was comments only not
discussion.
Kevin Brown of 18955 29 Mile Road inquired as to the
response of the Huron Clinton Metropark Authority on the limestone.
Bohm stated that the cost will be split with
the Township, each party will pay 5% of the total cost of the project.
Bill Kehrer 20015 30 Mile Road – stated that he had
a Brine application comment; a) many residents are upset with the conditions of
the road. The most recent application of brine seems inadequate.
Bohm stated that more rain is necessary to
activate the brine application.
Bohm also stated that the third application
funds will be used for spot applications in problem areas.
Zoccola stated that homeowners could possibly pay
for an application themselves; if they got together with neighbors to have it
applied to a whole section of road.
Bill Kehrer of 20015 30 Mile Road inquired: “What is
the township planning to do with the property?”
Bohm stated that the township is looking at possibly
another fire hall and a park.
Kehrer of 20015 30 Mile Road: How much property
faces Romeo Plank?
Bohm: Approximately 225 feet.
Helga Soave of 62251 North Avenue: thanked the
township for offering recycling and stated that she would like to see more recycling.
How does the Township know where these goods are being sent. Are they being
sorted?
Bohm stated that he toured the facility and
saw the process. He further stated that the Township is aware of the problems
with the current system and is looking into solutions.
Kevin Brown of 18955 29 Mile Road asked what would
happen if we told our waste hauler to recycle curbside.
Helga Soave of 62251 North Avenue: What about a gate
fee system?
Kevin Brown of 18955 29 Mile Road stated that
Centerline had a system that they had to abandon because it was too cumbersome.
Bohm stated that there are a couple of
promising options on the horizon: one is a packer truck that could be used; or
a shredder packer machine could be used; we are looking at the practicality of
these possibilities.
Terry Goike of 21122 32 Mile Road: Asked if there is a
way to talk to Washington and Bruce; and have the surrounding communities have this
available for their residents?
Terry Goike of 21122 32 Mile Road: Does Macomb have a recycling
program.
DiMaria of the Ray Township Fire Department
stated that there does seem to be a lot of non-residents coming into the
recycling center Signs will be posted that say “Ray Township Residents Only”.
He further stated that Macomb Township provides water for residents at the Macomb DPW yard. The Ray
Township Fire Fighters will hold a blood drive June 11, 2010.
Terry Goike of 21122 32 Mile Road: Historical Society
made $250 on their garage sale.
Tom Haynes of 21639 30 Mile Road: Suggested that a camera
could be put up at the recycling center.
Kevin Morton of 21511 30 Mile Road: What is the process
with the DNRE?
Bohm: Someone from the DNRE needs to come
out.
Kevin Morton of 21511 30 Mile Road: How long will that
take.
Bohm: stated that the report was made. Maria
Zingas told Cathy that the complaint was recorded.
Kevin Brown of 18955 29 Mile Road: Was there any
response to the activity on North Avenue.
Bohm: Stated that Greshams put two large
culverts in the road without a permit.
